CONNECTICUT IS THE NEWEST STATE TO LEGALIZE RECREATIONAL MARIJUANA - EFFECTIVE JULY 1ST 2021.

As you may be aware the legal landscape for employers that are drug testing for marijuana usage has significantly changed over the last several years.

Connecticut is the newest state to legalize recreational marijuana - effective July 1st 2021.

Although marijuana continues to be illegal at the federal level, more than half the states have elected to legalize medicinal and/or recreational usage, along with various states decriminalizing it.

We wanted to take this opportunity to remind our clients to review your drug testing program and policies.  Conducting regular assessments with the guidance of legal counsel is highly encouraged. You may want to consider screening in compliance with the state(s) your business is located, along with the state(s) your applicants reside and work in.  The shift to remote work is an added complexity for many employers.   

Recognizing that many of these laws do have exemptions (i.e., safety sensitive positions, public safety, positions requiring licensure), each state is uniquely administered and requires a careful assessment for your specific employment circumstances.
